Why Fair Housing Accessibility Evaluations? The Fair Housing Amendment Act of 1988 made it unlawful to design and construct certain multifamily dwellings in a manner that makes them inaccessible to persons with disabilities. The Act also established design and construction requirements. The Act applies to properties built for first occupancy after March 31, 1991 Lawsuits related to this Act have been filed against multifamily developers and owners nationwide.
