Effective July 1, 2005 Massachusetts joins the majority of states who enjoy clear guidelines on how to practice agency in real estate transactions.  The law clarifies four areas of practice:  a) the practice of sub-agency; b) facilitation (non-agency); c) designated agency; and d) dual agency.  These new guidelines require the usage of a new mandatory disclosure form, known as the Mandatory Licensee-Consumer Relationship Disclosure.  Further, the new 
statute and regulations require written consent before a REALTOR® offers compensation to subagents, practices 
dual agency, or practices designated agency. (The practice 
of facilitation requires prior disclosure via the new 
disclosure form.)

The Division of Professional Licensure Urges Consumers to Protect Themselves

"Consumers rely on home inspectors in making one of the most important purchases of their lives. I urge house hunters to check our website for disciplinary histories and consumer tips before hiring an inspector," said Anne L. Collins, Director of the Division of Professional Licensure in MA.

The Board of Registration of Home Inspectors ("Board") licenses over 450 home inspectors throughout the Commonwealth. In fiscal year 2004, the Board resolved 33 complaints, resulting in ten consent agreements, seven license probations and fines totaling $6,575.

Consumers are urged to visit the Division of Professional Licensure's website at www.mass.gov/reg and select the "check a license" option to determine whether a professional they are considering doing business with is licensed and in good standing.
